Roche is screwed. This is favorable development for Amgen. Judge will knock Roche out before FDA has a chance to approve the drung

This is the same judge that has already ruled for Amgen in another patent infringement involving the same drug against another company. I hate to break it to you: Roche is in trouble.

I'm not so sure how much trouble Roche is in. Mircera is a new class of drug - C.E.R.A (continuous erythropoietin receptor activator); in addition, it's a pegylated molecule.

Amgen's Aranesp and Ortho's Procrit are Erythropoietin stimulators.

Judge Young has scheduled a conference on Monday October 23rd at 2 PM between the legal parties (Amgen and Roche)

According to the Citigroup, this is an unusual move as the judge has not yet ruled on outstanding motions to hear or dismiss the case. Citigroup believes this announcement is favorable for Amgen since Amgen has been pushing for hearing. It seems as if Judge Young has already decided that he will maintain jurisdiction over this case and that he may be willing to discuss procedural issues for this case at this conference, including the timing for a potential trial.

If Judge Young were to issue a ruling for advancing this case towards a court trial, Citigroup believes this would be favorable for Amgen, as it suggest potential timely resolution or clarification in advance of a potential FDA approval for Mircera..

Amgen will likely to prevail in its patent infringement case. Amgen needs to demonstrate infringement of only 1 claim of 44 in its 6 patents. CERA has only 5% chance of ever getting into the US market.

Because it is from the same source that is Citigroup. Sentences were papraphrased from Citigroup for the sake of accuracy. CERA will not happen. We will not more Amgenities here for a false promise. They will have nothing to do when they come here after CERA fails. Management will eliminate our jobs to keep them here after CERA fails. We do not more Amgenies here period before this thing is approved.

Look, it's all about money. There's only only slim chance infringement will be substantiated. If it were to be proven, Roche would have to pay Amgen a royalty based on Mircera sales. No big deal.

Amgen needs to demonstrate infringement of only 1 claim of 44 in its 6 patents. You add the numbers and see who has the better chance! That is 2.5% chance for Roche and 97.5% chance for Amgen! Citigroup just came out and told the clients to buy more amgen shares since they see a knock out chance for Amgen by the end of October.

Roche has to win in 44 cases out of 44 cases, Amgen has to win in 1 case out of 44. Do you call this a slim chance of infringement?! There will not be any royalty fee. If Amgen wins even in 1 case out of 44, the drug will never reach the market! It will be stopped.

Well, the lawyers for TKTX also thought they had a "rock solid" case a few years go before judge Young (same Judge overseeing this case) ruled in favor of Amgen and stopped them from making the drug.

If this is the case, why did all the DMs got the confidential memos from the upper management for the if scenarios? Just ask your DM about the plan for you for the sake of your own family. Look at Roche's history. We had 3 launch meeting for Xenical. Cera will get launched, it may be in 2009 but it will be launched.

If you didn't get the memo about the potential reorganization, you should be concerned. Roche knows it is going to lose the case. they have already asked to remove Judge Young but failed. This is the same judge that ruled for Amgen in an identical case 5 years ago. Don't play with your family's future before the Holiday Season. CERA will never make into the US market.

Let me get this straight....because an of administrative hearing on the 23rd of October which may or may not involve protocol for setting up a trial months away (a trial that Roche and its leadership team always wanted so that they could demonsrate no patent infringement) for a case that could drag on for years, Roche management will be restructuring.....Wow, impressive research on what the 23rd is people. Also, seems realistic that they are bringing on people only weeks and days before to give out walking papers.....Oh, and doesn't Citigroup have a banking relationship with Amgen???? Yes, they do by the way. Why has Amgen and OBI senior management gone from saying that Roche will never launch to now stating that when they launch we will have to be prepared.... Meanwhile, keep up the good work OBI and Amgen rejects......Ever think that some of you just aren't cut out for this. Come on people; make your own decisions and don't be led like sheep. There is risk in every company in the US in every industry; including OBI and Amgen! Oh, senior management isn't telling you about that right?????
