PIP Plans are lawsuits waiting to happen

    Bull. If the DM properly documents that you didn't do what you were supposed to in the PIP. You're history. Most states are "employee at will" states and your ass is fired. Now if you want to take AZ to court they have lawyers sitting around with nothing to do and they win the vast majority of cases. HR watches PIPS and makes sure the DM does not put the company at risk for wrongful termination. So my friend many many legal minds review AZ policies on this matter and make sure the company will not lose any cases. You get a PIP you have two choices...one try and do what is on the PIP and survive. Of course that is not likely to happen. Look at the PIP as a 90 day wake up call to look for another job now.

    You "arm chair lawyers" kill me! AZ dealt with over 20,000 lawsuits, at the same time, against Seroquel. Do you honestly think for 1 second that AZ fears little people like you when you threaten a lawsuit????? Have at it!!! You don't stand a snowballs chance in hell!!

    But, if you can prove the company engaged in off-label promotion of one of AZ's drugs, contact a U.S. Attorney. THEN, you might have something!

    AZ will carefully craft managing you out if that is their desire. They won't move until they create a file big enough to do it. Every iota of your working life will be scrutinized and documented. Although numbers or managed care may have gotten the ball rolling, they are not going to use those as reasons. Your performance will be measured using subjective measurements. This has been done time and time and time again. Lawyers are retained around the nation and called in when needed. They know what they are doing. This area of the company is much larger than most employees realize, and it can be ugly.

    In the majority of cases your HR business partner is not here to help you, but to aid in managing you out.

    The reason for the PIP is to cover AZ's ass. Otherwise they'd fire you on the spot! The PIP is a set up. If you're on a PIP your chances of survival are effectively zero. It is like a paid time to find another job. If you are on a PIP you will be fired very soon, period.

    Make the best of it. Act like you are scared when your manager starts rigging with you once a week. Then when he's gone for the other four, get your calls entered on time and find something else.

    This is obvious. You will be fired, you are being set up, AZ has legal experts from Harvard and Stanford behind them, you do not have a snowball's chance in hell of doing anything except ruining your future employment chances if you resist in the lease. They have been to this rodeo many times. PIP = soon to be fired, get out while the getting is good. About a month you have, Obi Wan.

    Good luck with that lawsuit dumbfuck. AZ has legions of lawyers and they will win every time. The DM can put in subjective goals in your PIP which you cannot disprove. But go ahead and hire an attorney, they get rich off of whiny losers like you with no case. LOL

    The poster feels entitled to the job, bottom line. Who does AZ think they are firing him! It's not fair!! He can't do it and it's not his fault. Just because others are capable of doing much better with the same tools and same access problems, the law should make AZ keep him on, or at least pay him big money so he doesn't have to work or find another handout somewhere.

    Generation X. The reason the US is in its downward spiral.

    I wouldn't go so far as to simplify it down to GenXr's and entitlements. In some instances AZ can be very unfair.

    Wrong mr. know it all! They will not win, they will settle out of court. The PIP is bullying at it's best. Why isn't the whole pod put on a pip? Subjective will not hold up in court and they will not allow it to go to jury. Why don't you goggle some of this info or contact an attorney and asked them. Don't just assume. I have a friend who hired an attorney and worked with the rep on verbage to put in response to the PIP and heads rolled.

    I was put on a PIP ata company. Then they tried to fire me. I fought with an employment lawyer and they LOST.

    The problem is most of you don't realize there is a threshold that they don't even want to go to court, not worth the time or extra money so they will settle like 8/10 times.

    I have been with AZ for about 9 months now. I came from another industry and this environment was totally foreign to me. To say the least, I have been struggling and thought nobody cared or was paying attention. I now am proud to be a part of this organization. My boss rode with me last week and at the end of the day we sat down for a debriefing. I really thought he wasn't concerned about me or my career but I was wrong. He had actually been thinking about me and came up with a plan to help guide me. He has outlined specific tasks and goals for me to obtain and even put times to achieve them by. I really like that he is holding me accountable and will be showing me more individual attention. Now we get to communicate more frequently by email and phone. I was thinking he didn't like me or care but now he is spending more time with me than anyone else on his team. In fact what he came up with to help me even said Performance Improvement Plan as the title or PIP for short as he nicknamed it. We went over the details and I'm excited to say the least. Now I have specific targets to achieve that, as he said, are meant to help me more systematically reach larger goals. He said that he was even holding himself accountable to my success so that is why the HR department was aware of his actions. He said he had failed me but with this tool, that would be a living document, we would get back on track.

    I'm am so excited and happy to work for an organization like AZ that would put this type of ongoing training and development into their people.

    Life is good again

    Have you actually been there done that? When I say subjective I mean workday appraisals and calls rating ISS. Your manager will argue that you do not meet. This will take some time to do and will be documented, along with anything else that can be thrown at you. Argue your day in court if you will, but it will be your word against theirs. When you go to court with your single employment attorney (and you'd best check at will for your particular state to see if anyone will even represent you) you will be against a pool of attorneys representing AZ. Yeah, it's possible you may settle, but it ain't gonna be no cakewalk.

    I cannot believe all of the reps who have no sense of team or the word colleague. Do you think if Rich Daly called one of his peers at the executive level - would they sound like you do?? F this and F that?? That is why you will always be at the bottom. No sense of building and supporting work networks or colleagues. Your mentality is dog eat dog. Truly pathetic.
