They are stuck paying a royalty on their lateral cage, retractor maxcess and 2 cervical plates. it drops their total company margins by 2.7%. This is more of a hamstring than a kill shot. Nuvasive will survive but this really hurts their ability to grow. They bought a IOM company this week to diversify their offering. Anyone ever think if they have an employee in your room doing monitoring how much dirt they are going to pick up on docs the are going after? They will know what the surgeon likes, doesn't like and when something in the case goes wrong with the existing vendor. Everything. Basically they will have a spy in every room. i don't know if they thought that out or if it was pure business diversity play but that will be the effect. IOM's head hunting your surgeons. fascinating.
More trials coming - same allegations over other devices. It will whittle NUV profits because of the royalties they must pay, as well as the jury awards. Now they get a clue and attempt to get a patent on their "innovations" (the coil spring lock) - which is how Medtronic got the legitimate rights to develop products. Lukianov doesn't appreciate the ethics behind business, and has now come to fruition. The improvement on an old idea - which NUV essentially capitalizes on - must be accomplished in a way that is safe for investors (the owners of the company), its employees and the growth of the company. Either come up with a brand new product and get the patent, or partner with the companies you're stealing from. Lukianov, Valentine and Miles forged ahead with stolen ideas - they can't prove otherwise. No proof of the development and ultimate filing of patents for innovative products. Miles, a sales rep, says at trial he created XLIF - what a joke. The upcoming trials, the appeals will take years, and NUV will continue selling products. If you want to ride their coattails a little longer, do so with an eye at your back, but my bet is they won't be around in 5 yrs.
