No it isn't. Nuvasive is currently appealing the ruling in 2011. Just accused the Judge of not knowing the law. Current event....
They didn't lose the technology, just the name. They can put a new sticker on the machine and go about business as usual.
.........After paying $60 million PLUS whatever the other company claims as copyright damages after the last ruling until the new one.
