What Ameritox is doing

Target suboxone and methadone clinics hard. Easy way to get 10-100 specimens a day. Coverage is great. Just get names loaded into data base keep it simple for the clinics. Ameritox is not sending to collections so they don't mind sending cash pay. They are sending patients multiple bills and calling them. Most pts are still getting bills from 250-2000$ don't let them fool physicians

United States files brief against Millennium Health appeal in urine drug testing cup suit

The United States has filed an amicus curiae (friend of the court) brief that urges the Eleventh Circuit Court of Appeals to reject the appeal filed by Millennium Health (MH) in a case in which a jury found MH violated both the Stark Law and the federal Anti-Kickback Statute (AKS) by providing free point-of-care urine drug testing (POCT) cups to physicians.

I am writing about this brief because it is my understanding (although I could be wrong) this is very unusual and may be the first instance in which the US has filed an amicus brief in a civil case involving Stark and AKS issues in which it was not a party.

 

Hmm. Interesting that this DOJ brief mentions the False Claim Act. Can't be long before the Guvmint lands that blow.

 

Now they are offering cups below market price and telling doctors they can only use those cups for Millennium tests. It would not surprise me if they weren't collecting on the cup invoices sent to the doctors.

 

I know in Utah the Millenium rep has told addiction clinics they can bill for the cups as a high complexity test. I know of clinics who are collecting $500+ on a POC cup. Super ethical.

Spectra continually seeks to employ professional, self-motivated individuals across the nation who can deliver customers requiring clinical testing to Spectra-owned laboratories. Our sales employees fall into two categories:

A Sales Executive: a full or part-time employee who typically receives a base salary (based on previous performance) and who has the opportunity to earn an uncapped sales commission that is calculated as a direct function of the delivery of paying accounts by the Sales Executive to the company; and
An “In-House” Sales Executive: a full-time employee who will be allocated certain accounts by company management requiring sales and marketing service and who thus will be directed by Spectra to targeted sales opportunities. This type of sales employee will typically secure a substantive salary and will have the opportunity to earn sales commissions upon meeting company-determined targets and goals.
Spectra will only pay volume or value-based commissions to individuals who enter into a direct employment agreement with the company.

1099 type agreements or contracts with companies or personally-owned entities will be entitled to receive commission-related payments.

Sales employees will receive all the necessary training on Spectra processes, software and policies and will be required to uphold the highest standards of ethics and compliance with all pertinent laws and legislation; in turn, sales employees have the opportunity to provide a service that is both required by the client and financially rewarding for the Sales Executive.

Federal Court Rules Millennium Health Infringes Patent Exclusively Licensed to Ameritox

The Chief Judge of the Western District of Wisconsin, William M. Conley, wrote in his Summary Judgment Order: "While ... shortcomings in the data used in Millennium's RADAR® Report may well make for an inferior product, they do not render the product non-infringing."
