The arthrex rep in my territory has a bag full of none arthrex products. Almost like arthrex is a side gig to him.
Legally, ain't nothing Arthrex can do when an independent contractor (1099) carries non-Arthrex products. Ask any employment lawyer.
Not when your contract says you can't compete against arthrex, like mine does. I got in here as a foot in the door from Pharma.
The "non-compete" does not stop me. Our managers are too busy at the gym or golf course to even look in my trunk for anything competitive. I had a close call when I left a brochure on the passenger side... I told him I found it it an office and took it.. He laughed and gave me a high-five..The douche.
If challenged your contract might not hold up in court. Each state is different. Someone should bring the legal hammer down on Arthrex in Arizona. Zona legal precedent favors the 1099.
Non competes hold up 6 months max in AZ. Might cost some cash but you can almost wipe your ass with contracts in AZ.
