Does anyone know the status of the whistleblower case?

Last I heard the, the Feds are going after Coloplast, Byram and Shield. Something about defrauding California’s Medicaid program by falsely inflating prices. There was also talk about violating a prohibition of calling Medicare beneficiaries through a telemarketing campaign.

I did a quick Google search and found this. Curious if anyone has heard anything more on this and what it means for Coloplast.

Wow! I just clicked that link! I opened a few of the documents. It appears that the entire industry for ostomy and continence had been in cahoots for years!! Manufactures and dealers!

Has the entire CARE program been illegal from the start??!!

The last one looks like everyone is settling. I hope this spells the end of pushing these damn CARE leads and get us back to selling!

 

I don't think it was illegal at the start (pre-2008 or so). Since then, based on this document at least - seems out of control (paying dealer reps with gift cards, Medi-cal dealer rebates, hidden compensation via samples etc.).

EV must be feeling a little "warm".

Give some credit to KH and others for pushing back on what they thought was not right.

 

pg. 42 The defendant manufacturers representatives pitched the programs by misleading health professionals into thinking that if they enrolled patients into the programs patients would be provided only with informational resources to help adjust to their new lives using ostomy and continence care products after discharge as well as navigate complicated insurance Medicare and Medicaid coverage rules to better ensure patients could afford the products. As such the defendant manufacturers duped health professionals into becoming unwitting and uncompensated sales people enrolling patients into the CARE and/or Secure Start programs by exploiting the trust these patients had in their caretakers.
Has anyone been advised to sell CARE enrollment differently? The last thing I want is to be a part of any future litigation.

 

Given that we're supposed to be sales reps, why PAY us to enroll patients in these programs? Do we actually think that Coloplast is spending big money to send out 'educational' material? What do they have to gain by doing this? This place isn't a non-profit but they're using this patient info for different reasons. None of it has to do with 'educating' patients.

 

EV and ML just dont get it. They are rabid for names and catheter Rx's. Inside reps are just tracking down the offices and suppliers for the Rx, also. Pissing off TM accounts.

So if you are a pharm rep lurking here with any form of Urology experience you are Guaranteed to be hired.

 

would be nice if we could post on this topic here with reliable trustworthy peers. Unfortunately we know these boards are so closely monitored and manipulated closely by the paid for rats for hire. Any thing of value for clarification that we type on these sites, is ripped off and placed in a report...for some one else's hefty profit. Lets converse on closed sites. Hell, No one does our job for us for free.

 

They do get it from this perspective... acquire enough leads, confirm the patient is using our product, create the direct "advisory" relationship... it paves the way for a direct sales model that cuts out dealers, lessens the need for sales reps (ironic, isn't it?) and grows the bottom line for CP.
