Commission of federal funds

    Showing that Feds are now prosecuting against firms that pay commission on federal funds.. reps are not to be commissioned off federal finds now with case precedence. What does that mean for independent labs that live off that model. Will they have to request money back form the reps? Also, what stopping reps from turning in labs that pay commission off of federal funds? I think labs are next. Everyin said the compound pharmacies would be okay, and now they are falling down one by one. With the owners and reps now being charged and forced to give money back. For whistle blowers this is a no brainer and almost too good to be true! There are literally hundreds of labs that can be turned in for paying reps commissions on federal samples. Let's make our pay day and turn the crooks in!

    It is impossible to tell what case you were referring to as that is basically a blog and not a legit news site. In every case I have seen so far the reps were usually paying the physician to write scripts and/or they were paying the patients to get the scripts. That is illegal regardless of whether it is for Federal or commercial insurance.
    You need to clarify the statement about labs paying commission on Federal Lab specimens. If you are a W-2 rep for a lab then you can be paid a bonus for federal specimens which some people may call a commission but should not be an actual commission if set up legally.

    Show me where you can't pay a commission on Medicare or Medicaid, but you can pay a bonus. Commissions are allowed on federal samples as long as they are reasonable. Paying someone say 6% on a sample is fine. It is when you pay say 40% that gets you in trouble. People on this site need to know what the hell the law is!

    OK moron, the case was a criminal case involving an independent rep in a pharmacy that had payoffs and forgery. Also it had a clause in the agreement that subcontracting is not allowed. How you take the leap to a W-2 rep is beyond me? OIG ruled in 2013 that commissions for W-2 reps in lab are fine as long as they are reasonable. You should really educate yourself before you start spreading your nonsense. Go back to school junior!
