Settlement... What's Taking so Long?

    We're two years into the commentary from management that settling the DOJ issues are an immediate, high priority. WTF is taking so long?

    Kapoor offered $150M and the feds want $1.2B, i.e. 3X all sales as 99% were off-label and driven by bribes.

    Hopefully that narcissist rots in jail while giving rusty trombones daily. Generally, DOJ gets 2x the illegal gain or 2x the government's loss, whichever is greater.

    treble damages...the govt will come after the company for 3x what the company bilked govt funded programs for (Medicare, Tricare, Medicaid) - and that’s where the settlement negotiations begin. So whatever $ Subsys made off of those programs, multiply that by 3 and let settlement negotiations begin.

    If someone knows what Subsys made off those programs from 2012 -2015/16 then simply multiply that by 3 and you’ll get a more realistic picture of settlement figures.

    Doubtful as that would vastly exceed the company's assets today. Don't you think DOJ will give Insys a break?

    That's ridiculous. Go look at settlement history with DOJ of previous cases.

    This will settle for $200M or less, easily.

    cephalon settled for $425m W Actiq (same molecule as subsys) and maybe another therapy as well. Lots of deaths due to subsys & upper mgmt was fully engaged in the marketing & getting it into any & everyone’s hands that it could...I think it’ll be well over $200m. Oh yeah, jail time too for some

    Well, we know the Federal fine will be at a MINIMUM $150 million (Mr. CFO just put this minimum on the books) which eliminates 85% of the cash Insys has today.

    Layer in the state fines, insurance company settlements, patient litigation amounts... and my 4 year old could conclude that the company is insolvent.

    Good thing Subsys script trends are growing. Oh, wait...
