    Judicial OVER reach? LMFAO !!! A few thoughts:

    1) The Constitution set up our court system as the basis of our law

    2) If no judges, what/ who do we use?

    3) As far as ‘interpreting the Constitution’ - remember, even conservatives ‘interpret the Constitution. I’m reminded of the flag burning case before SCOTUS where Scalia (arguably one of the most conservative in modern time) was the swing vote in a 5 – 4 case that ruled against it being a crime. Conservatives, expecting the law to be upheld were shocked. His comment? “As much as it kills me, I must rule this way to preserve our freedom of speech”

    My point – even among conservatives, the Constitution isn’t as simple as black or white. I see no alternative to judges and there will ALWAYS be disagreement – even between the judges. This was a 5 – 4 ruling

    Buh-bye !!! ;)
    on a conservative court.


    Anyway, hope the weather isn’t too bad back there, we had rain all night, no rain today, then 4 more days of rain. Daytime temp in the 60s , night-time temp in 40s but BOTH feel colder as it is damp with some light winds. I’m in the process of booking pour 2 week Phoenix adventure for skinny dipping, Spring Training and quality time with my sister’s family and several old good friends from High School as well as my first CA beach town – Manhattan Beach.

    Yeah, a few thoughts alright. Sadly they are ignorant and erroneous thoughts.

    1. The constitution did no such thing. ALL legislative ie lawmaking power is invested in the legislature. Case closed.

    2. Easy the people through their elected officials because those officials are subject to being voted out, unlike judges, if they have acted in a manner the people don’t like.

    3. Yes, the constitution must be interpreted but even there, the judges don’t get the last word. They get a word, but no more a word than the president or the legislative branch. And the only legitimate type of interpretation is original intent which is quite easy to ascertain in most cases.

    Judges are not wise men. They aren’t a cut above us or immune to the corrupting influence of power.

    They aren’t philosopher kings. They’re essentially just a bunch of egomaniacs in black robes who don’t know their limits.

    If you were really interested in learning something, you would study what Jefferson thought of your attitude about the courts and judges. Jackson and Lincoln too for that matter. But you’re ignorant as well as stupid and determined to stay that way.

    You are a fine example of why our nation is on the brink of destruction with Trump being one of the few things holding us back from that destruction.

    Article Three of the United States Constitution establishes the judicial branch of the federal government. Under Article Three, the judicial branch consists of the Supreme Court of the United States, as well as lower courts created by Congress.

    And I was correct. It set up the courts but not your characterization of their role.

    Once again your lack of even a 5th grade reading level betrays you.

    You lose as evidence of your evasion of the argument I’ve crafted one shared by Jefferson, Jackson and Lincoln and countless others.

    Furthermore, Trump's claim that it's the 10th Circuit Appeals court that most often reverses #SCOTUS is categorically false, whether over the last two years, five years, or longer. In fact, that honor goes to the Third Circuit (NJ, PA, DE, VI).

    As I've noted previously, over the past five Terms, three other circuits have been reversed in a higher percentage of the cases #SCOTUS has reviewed from those courts (the Third, Sixth, and Eleventh Circuits):


    It's true, of course, that the Ninth Circuit has the most _total_ reversals, but that's because #SCOTUS hears more cases from that appeals court than any other. It also has the most affirmances over the same time periods.

    A PolitiFact investigation in 2017 found that the Supreme Court overturned 79% of cases it reviewed from the 9th Circuit from 2010 to 2015, though less than 1% of the total number of cases ruled by the circuit court got overturned.

    Furthermore, PolitiFact found that the 9th Circuit didn't have the highest rate of cases reviewed and overturned by the Supreme Court in that period — the 6th Circuit did, with 87%
