Signing Severance Letter

    I am currently on a performance improvement plan, which often ends with termination of a sales rep at my company.
    Often, there is a nominal severance payout given if you agree to sign a stack of papers giving up your rights to sue or make any future claims against the company.
    By signing this severance agreement, would I be unable to file and potentially collect any claims from a whistleblower suit?

    Signing a severance agreement does not impede your right to file a whistleblower claim alleging fraud but it might hinder your ability to collect any reward. The courts have ruled that in some cases severance pay could be considered as payment in place of any future reward from settling your fraud case. We would urge you to consult an attorney before signing any severance documentation presented by your employer. If you have a copy of the agreement, we would gladly give you our assessment of the severance agreement as well as the strength of your fraud allegations. In cases like this you have to outweigh the amount you’re going to receive from the severance against any potential whistleblower reward.

    Have you ever been able to receive a "severance", "separation", "hush money", "good will" whatever you want to call it payment for a client after they have been fired and REFUSED TO SIGN a company severance letter?
