You may be 100% correct here. But, that doesn't mean she's above the law. She did what she did & will have to pay the consequences. I do think her actions pale in comparison to any sort of violent crime. But, one could STRONGLY argue that Carrie's actions (coupled w/ Enhance) was a major catalyst in the death of Schering-Plough. I mean, we are in a "perception-is-reality" world [Fred strongly believes this]. Shareholders saw the peculiar timing of Carrie's sell-off as a sign that Schering could be the next fraudulent company in-line with Enron! This perception greatly devalued the company (more so than w/ ENHANCE alone), thus allowing Merck to acquire SP easily, thus causing 16,000 employee cuts... Now do you see why there's such venom towards Cox??
Carrie DID in fact go to legal before exercising her options. But, did she tell them that she knew of the ENHANCE results?? Did legal know that Fred & Carrie were dragging their feet to delay the announcement? Even if Legal knew everything, that still doesn't preclude her from insider trading!
