    Illinois Union Insurance Co. (UNION) seeks to rescind an Intuitive insurance policy, saying the maker of the $1.5 million da Vinci robot system concealed material facts about its legal risks.

    Navigators Specialty Insurance Co. also filed lawsuits against Intuitive Surgical, Inc. Because they believe Intuitive is lying about pending lawsuit liability. Some estimate the risk of product liability Intuitive is facing to be over 3.5 BILLION and climbing.


    Over 3000 claims and counting.

    No wonder there are REPS on this board worrying about victims or what they might do.

    NEW ORLEANS (CN) - Fifteen patients demand $1.2 billion from a robotic surgery equipment maker, claiming it uses "fear" and "intimidation" to push the defective Da Vinci Robotic Device on doctors and hospitals.

    Lead plaintiff Twila Beasley et al. sued Intuitive Surgical in Federal Court. They claim Intuitive suppressed evidence that its defective Da Vinci Robotic Device can injure and kill patients.

    A Parlin woman has filed suit against Intuitive Surgical, claiming robotic surgery left her with chronic abdominal pain and severe bowel issues.

    Sheena Wilson, 45, alleges Intuitive Surgical, the multibillion company that manufactures the da Vinci robot, knew of the possibility the electrical current from one of the robot's arms can "jump" from the tip of the device into the patient, possibly causing serious injury. The suit, filed in federal court, further alleges that the company failed to tell surgeons and hospitals of this potential problem in a timely manner.

    "They certainly didn't notify all the previous purchasers or trained surgeons of this defect," said Chris Franzblau, Wilson's attorney.

    For hysterectomies, specifically, the 2013 Journal of American Medical Association study found that the addition of a robot to traditional laparoscopic hysterectomy added $2,189 to each case. In two studies published in the Obstetrics & Gynecology journal, researchers found similar conclusions: Removal of ovaries and ovarian cysts cost $2,504 and $3,311 more, respectively, while another study found hospital costs to patients who underwent robotic hysterectomies paid an average of $2,489 more than patients who had a traditional laparoscopic procedure.

    In an editorial based on a 2013 study in the Journal of the American Medical Association, Boston's Brigham and Women's Hospital Drs. Joel S. Weissman and Michael Zinner wondered whether the money spent on robot-assisted surgeries could go toward other uses: "Would it be a better use of resources to train more surgeons in (traditional) laparoscopic techniques, than to spend the money on more robot machines?"

    Intuitive Surgical (NASDAQ:ISRG) Director Lonnie M. Smith sold 20,000 shares of the stock in a transaction dated Tuesday, January 27th. The shares were sold at an average price of $511.31, for a total value of $10,226,200.00.


    Lonnie keeps getting richer and richer dumping this stock... Its down to 501 today.

    Looks like they decided to keep the money instead of settling lawsuits? Best invest in security and stay out on the yachts... as soon as they hit land and peek their heads up in public... Victims like the new American war movie a lot! Mr. L. Smith has a weapon (the robot) and is the enemy. (who I must protect my family and way of life from.) All who work for the terrorist and his network must be eliminated! They are well funded and have no value of life or limb of humanity. The say "its for the good (or their faith)" All the while real people die a horrible death. All the while each one in the "network" looks away and cashes their paycheck... wasn't me - not my fault - but you knew! EACH AND EVERY ONE OF YOU!

    Friedman’s theory on individualism states that the only goal of business is to profit, so the only obligation that the business person has is to maximize profit for the owners or the stakeholders. For everyone involved there is booming profits to be found, this machine allows private doctors and public hospitals to move people in and out of surgery much faster. Patents matter little compared to profits.

    Video documented insulation failure of Robotic monopolar hot shear instrument, during Robotic assisted hysterectomy procedure. Insulation failure seen as sparks, firing against the posterior wall serosa of the uterine corpus. This is related to malfunction of the monopolar instrument (hot shear) sleeve. Carful handling of the instrument (and it's shortcomings) is a must , to avoid injury to surrounding structures in the operative field (such as bowel). Frequent change, as needed, of the hot shear monoplar instrument is need to avoid such failure.

    Uterine Perforation of Colpotomizer is shown. It is an underestimated & underreported complication of Laparoscopic and Robotic Gynecologic Surgery. Question is : DOES THIS COMPLICATION AFFECT STAGING OF ENDOMETRIAL CANCER ? AND DOES IT AFFECT THE MANAGEMENT/PROGNOSIS. Insulation Failure is showed at the end of the Video clip.

    This next video is well after the recall and well after the sleeve fix and it is still burning patents. Why ?

    An underreported Robotic instrument malfunction.
    It is difficult to recognize and it might add to the risk of Insulation Failure.

    They will show video of "non-robotic" surgery camera views -doing the same thing. They will say all surgery done "electro" for cutting and "burning to stop bleeding" is common. The videos show leakage... yes. But... It's when it leaks OUT OF THE VIEW of the camera and the Dr. don't catch it... that's the problem. They will say "non - robot" Lapo. surgery runs the same risk... Guess they got a point if you look at it from their side.

    It's the knowing that there was a problem and not testing or alerting the FDA asap about it...
    That's the chicken dinner winner winner. in my opinion.

    Videos will be used on both sides ya know... If you never seen a surgery before it has it's dramatic effect with the seeing of sparks and smoke and blood... But seeing a bunch of "successful" video surgeries of the same (sorta) gross stuff... looses its effect. Then your right back to THE FACTS...

    I also heard some executive say "it's not I.S. job to train Dr.'s.... Medical school does."
    (that's their defense of inadequate training provided)

    If they don't train the Dr.'s why then in the many lawsuits do they say "does at all times, Intuitive Surgical asserts that it provided "adequate training" resources to healthcare providers and the labeling for the da Vinci Surgical System accurately conveyed the risks and benefits of the System."

    The resources FOR TRAINING healthcare providers is the "Medical Schools" job or I.S.? Why then do they make that statement... in open court? Are you saying that their training is inadequate? Not needed? Not required? But they agreed to adequately train healthcare providers in order to obtain FDA approval...? remember?

    Please explain because Me thinks you u is trying to be cute and brush this statement off...
    Does Boeing let anybody with a pilot lic. to fly? If the guys got a pilot lic. (& $) he can buy a 747 and practice over people? Boeing would have no responsibility in selling it to um if he crashes it? had lic. to fly so... not our job to train. It's the flight schools job. no law says we can't sell to a guy with a lic. so... We here to make $ people! screw the public! last I checked... the jury is the public... please explain

    It's called "capacitive coupling" and it has the potential to occur in any procedure where electrosurgery is used. Insulation does not guarantee that stray current will not occur and there need not be an insulation failure for stray current to cause unintended thermal injury. The dangers of capacitive coupling in laparoscopic surgery have been well known for years and have largely been mitigated through technological advancements and techniques that favor low voltage dissection.

    There are a number of factors that could have resulted in the incidents shown in these videos and the adverse outcomes described in the lawsuits. Most of them are out of the control of the device manufacturer. Most surgeons receive zero training on the safe and effective use of electrosurgery, yet robotic procedures rely heavily on this technology to achieve the desired outcome. I expect it would be difficult to prove that ISI is directly responsible for injuries that occurred from capacitive coupling. What could be shown is that they knew of the danger, or a potential product defect, and failed to notify customers and/or take corrective actions.

    The cover-up is often punished more harshly than the actual crime.

    It's called insulation failure of Robotic monopolar hot shear instrument, during Robotic assisted hysterectomy procedure. And according to the FDA Mauda report it has happened over 4000 times.

    When you see the videos of your robot failing and you read the reports from the FDA about your robot failing, and when you read reputable news reports about your robot failing. You then read outside independent medical reviews about your robot failing and then you read about your robots recalls... Then you see over 9000 medical adverse events reported to the maude report ( no way all those doctors are incompetent, there is no way all those doctors are all making the same mistakes ). It's easy to come to a conclusion that your robot has a very dangerous defect!

    You should not be surprised to hear, "If is looks like a duck and sounds like it's a duck. It's probably a duck".

    Latin for "the thing speaks for itself," a doctrine of law that one is presumed to be negligent even though there is no specific evidence of an act of negligence, and without negligence the accident would not have happened.
