Be sure to add "intent to deceive a Magistrate Judge" to joke's 2014 list of shame, giving well-deserved co-credit to his legal accomplices: Julia Henry of MORRIS, NICHOLS, ARSHT & TUNNEL, LLP and Joseph R. Re, Jon W. Gurka, Karen Weil, Perry D. Oldham, & Steve Jensen of KNOBBE, MARTENS, OLSON & BEAR, LLP.

High-dollar attorneys screw up bad sometimes too.. Had they sooner Philips' inadequate responses to discovery, would be in much better position. But the stalling appears to have backfired this time. Well, Cheif Judge L. Stark is now permitting the indirect infringement allegations to be tried.

And they failed to convince the Judge additional info would be necessary as part of a proper damages analysis. Compelling/additional info, if there was any, coulda changed everything.

Given the serious nature & scope of Masimo's recent exposures and the unprecedented level of change required for them to begin recovering, joker is fortunate to have only lost a half-billion dollars in market cap during those three years ($0.64 billion lost between 2011-14) Without his connections to high society and practically limitless financial resources, the disappointing exposure(s), especially those involving the FDA, DOJ & US Attorney, may have proven too devastating for the public to accept, forgive and move on. It shouldn't be so easy as that anyway.

Masimo and funky fandango are interchangeable, both doubling as nouns and adjectives. As in...
"The naive employee partook in a few Masimo Fandangos shell deeply regret for years."
Or... "How Masimo of him to pick out all the cashews, and discard the peanuts on the floor."

So essentially Masimo's worth is down by $640 million from three years ago. Who can expain that, when their revenues have been on steady climb every year. Could it be their legal problems that are stacked up to their eye balls? Or their net profits that continue to decrease every quarter despite the consisten revenue growth? Or maybe it's a simple bad reputation problem. Who knows or cares why, I just enjoy a good collapse of a company that has earned it.
