Does anyone know how long you have to work for AZ to receive FMLA benefits.... meaning if you have been with the company under a year but around 8 months prior to leave are you entitled or will they fire you?

    Thank you.

HQ guy here... Technically you can be terminated unless you are in California. In that case your job is secure for 12 weeks. The other states say same thing but there are loopholes around other state. Having said that, if your manager wants you out you will be out unless you live in Cali. A lot of folks think FMLA and STD protects them. Nope. It only provides you income and/or job protection in most cases. In Cali FMLA guarantees job protection and income after that for 1 year as they have a 12 month STD. But even there after 12 weeks you can be terminated. Good luck

My understanding is FMLA is after one year and your job is safe for the stated time but you get no income. STD you collect a portion of your pay for up to six months after which time you face the music. You get STD as part of your health benefit right away.

You can be fired for other reasons while on FMLA.
