Class-Action Lawsuit
Letters came in the mail today. What are everyone's thoughts?
I'm a little worried that if BI loses, they will have to pay people something and it will cost enough to make them have to lay people off after that.
Another concern I've heard is that people will get paid out something like $25 dollars each but will then have new restrictions to their job to make sure this doesn't happen again, e.g. clocking in and out via computer somehow to log hours, working only 30 hours for 75% pay....

This doesn't have a prayer and quite frankly whomever brought this lawsuit about certainly can't read the documents they signed that clearly states that this position sometimes requires additional time above and beyond the normal 8-5 day (training, POA, programs, etc.) This has to be a joke.

Anyone in pharma sales working over 40 hours/week is doing something wrong. As for the merits of the lawsuit, it does not matter if you signed anything saying that you will work more than 40 hours a week. Federal law states that overtime must be paid unless you are an outside sales rep. In order to be a sales rep, you must actually sell something to a customer. As you know, we do not sell anything at all. This is purely a marketing position and is not sales at all

BIPI is covered under the Fair Labor Standards Act. Based on section 7 of FLSA the employer (ie BIPI) should pay hours worked over 40 on a work week at a rate no less than time and a half of the regular rate of pay, for all bona fide non-exempt employees. BIPI pharmceutical sales reps (primary care, specialty,hospital,managed care, etc) do not fall within the scope of the definition of outside sales representatives as defined in section 3(k) of the FLSA therefore should be considered bona fide non-exempt employees.
How much in backwages is owed? It could be quite a chunk since we all know that pharmaceutical sales employees rack a lot of hours per week and this affects past and present employees.
This may imply a shift in the way compensation is determined, and definitely a possible change in BIPI's sales organization model that may extend to the industry as a whole.
Knowing BIPI as I know them, it will be a long fight but at the end the Act will prevail.

OMG, Fresh from the mailbox arriving today is U.S. District Court for the District of Connecticut, Case No. 3:06-CV-1985(JBA).
3 employees VS BI Pharmaceuticals, Inc. Page 2, 3rd paragraph states, "On September 29, 2008, the Court ruled that Boehringer's pharmaceuitcal representatives do not fall within the outside sales employees exemption to federal overtime laws."
The Court is letting this one go to a jury. Other Pharma Companies have successfully stopped these types of lawsuits earlier in the process, I guess Legal Dept was sleeping on this one. We have until January 16th, 2009 to join this classaction suit or bring your own lawsuit.
I will certainly be keeping closer tabs on my overtime hours and logging all conference calls, speaker programs, breakfast and dinners with providers outside of 8 to 5 working hours. Also, any documented POA assignments, training/compliance module assignments, and homework etc. required by management will get documented.

joined today. I actually documented my weekly hours since date of hire. The only and i mean only reason I did this was the dickhead manager that told me travel time to my territory targets was to be done on my time. So, when I had to see a target at 8:30am who was 3.5 hours away, - you guessed it- I was on the road at 5am and home after 8-9pm at nite. I always hated putting in 70hrs a week due to travel time and then having to waste an entire Sunday doing online training. For lazy asses looking for an extra buck- of course this is bullshit- but for everyone who was forced by a tyrant manager to give up their lives out side of normal work hours doing work related activities- it's only fair this type of crap end. I fully expect that when i get the check, the stamp and envelope will be more than the check itself but we need to establish a precedent for this travel time on your own time crap.

Here's a solution....move closer to your targets. The tyrant manager did not tell you to live so far away. You are just a dumbass looking for an easy way to take more money from the company.
I wonder how many people out there that commute to work get paid for their time sitting in traffic, on the train, bus, etc. I also know the answer to this rhetorical question....NONE!

Dear Colleagues,
Based on FDA and BIPI Sample Control Regulations, each sales representative is required to load samples when they start working in the morning (and unload them at the end of the day). That, in itself, marks the begining of work time. Every BIPI related thing that happens after the loading of samples is considered work time and should be compensable by law(Please see 29 CFR 785 - Subpart C - Work Time. Just go to Google and enter "29CFR785" in the search window. Whithin the first three search results, there should be a link to this section of the Code of Federal Regulations. Review it! Knowledge Is Power!) therefore your travel time after that point should be logged in as work time. My advice to all of you, dear friends, keep a log of all those hours. I can assure, when the time of reckoning comes, you will be receiving plenty more than $25. Do not be afraid to claim what is lawfully yours!

This ia really short sighted. If you plan on making a career in pharma sales at any level, then you participating in this will only force pharma companies to make changes that negatively affect us.
This suit is being brought by former employees trying to cash in. If you are a current employee why would you want to crap in your own backyard?

The sales organization model in the pharmaceutical industry is going to change anyway. Just look around you. Companies are downsizing. Once the new federal government administration is in place, the rules of the game are going to change.
Besides...since when defending your rights equals crapping on your own back yard?
Do not be naive - when the time comes, if BIPI has to downsize, they will eliminate as many positions as needed for the sake of the bottom line. They will always look for their survival not for yours.

This post sounds like it might very well be true, and likely is since the poster has very good knowledge of the legal code. I would not be surprised if it isnt the lawyer or someone in their firm who is representing the plantiffs.
One thing to keep in mind regarding what was posted...If you signed somethings saying that you would comply with all FDA and company policies regarding samples, AND it does indeed say that you are required to load and unload your samples daily, then be VERY careful. If you signed that, and you DID NOT load and unload daily, you are in violation of your agreement and are subject to termination and action. If you have violated FDA sample handling practices, you yourself might just be the butt of the joke.
Having been in the industry for over 20 years in almost every field related postion and many home office ones, I can tell you that few IF ANY actually load and unload daily. The exception to the rule might be those that have temp. controlled items.
In many companies, they have a practice, if not a policy of asking reps to prepare their car at the end of the day for the following day. If that is done, then the travel time to your "first" customer contact would be considered commute time and not work time. The impact of this touches many areas. Commute time is considered personal use and not company business. Since most companies charge employees for their personal use on a mileage basis, you could also be liable for those miles to the company. If you have not accurately reporting (which few do) those miles, you could be in violation of IRS tax laws.
As with any professional job that compensates well, there is an expectation of doing what is appropriate and necessary to get the job done. Yes, there are some very difficult managers in the business who expect unreasonable amounts of time. But on the average, most are not and most representatives have a very good situation and get paid far more than they would ever dream of for working the hours they REALLY work.
The greater concern a representative might want to be concerned with, is the need for representatives. If the regulations keep restricting the access and information that a representative can share, and heaven forbid that the reps no longer be able to deliver samples, the value found in a live rep might drop below the cost of having them.
Reps might want to focus on creating a great value for their companies and their customers. Seek to have an interaction with your customer that is meaningful and beneficial for them so that regardless of the situation, you are providing value. Be more than a marketing billboard. Have enough knowledge, expertise and trust with your customer that they dont mind having an interaction with you.
If that doesnt happen across the industry sooner than later, the seekers of this law suit might get what they are wanting. Hourly wages. If you truly want to be compensated hourly, then I promise reps will be the big loosers. As many have said, it doesnt take a good rep 40 hours to do the job most weeks. Many if not most, enjoy the flexability to do personal things during the work day, which is fine, if they are getting their work done. But if you were to go to hourly wages and continue in the same work ethic, those very same people will become liable for fraud, if they dont report their work time accurately. Companies will become more motivated to track and monitor rep activity and the GPS which NO ONE currently uses, would likely become activated and standard of operation. And why not, if you want to be paid overtime for the hours outside of 8-5, then be accountable for the hours between 8 & 5.

I have sold Aggrenox, Atrovent, Atrovent Nasal Spray, Catapress TTS, Combivent, Flomax, Mobic, Spiriva etc. I have sold Viramune when there was not even an HIV division. I saw the disastrous Micardis 1st launch and the subsequent failed attempts to resurrect it through Roubick's cubes, bridges, trucks, ABPMs and Mycards. In short, I've been there and done that. I am just concerned and frustrated to see that through all these years more and more work is given to the sales force who is the one who make the revenues for the company. Look at you! Calling on your targets, doing speaker programs, and keeping up with your samples is just not enough. Nowadays you have to deal with and increasingly slower Vista, computer glitches, POA meetings, defective target planners, conventions, integrated pharma and their messing up of reconciliations, trainings, increasingly complex expense reports, and many other things that I do not even want to remember. As a result of this work/family balance is tilted towards work. Do the exercise - divide your salary+benfits per year by your total hours worked per year-see how much it is per hour ... you will be amazed to see that your compensation is going down the drain (this is specially true considering what Marty, Bob & Company have done to your bonuses lately).
By the way - personal miles are charged to your W-2 as personal income.

Down the drain? So what have the Sr. Exec's done with out bonuses? Please explain. You seem to have alot of opinions, but how about some solid proof?
Slower Vista? How about you get some broadband access in that cave you live in? With the way reps treat their computers, no wonder there are these 'glitches.' When have we NOT had POA meetings? (FYI...they are decreasing in duration next year.) Due to pharma, participation in conventions and trade shows may lessen too. Expense reports are much easier than those old Gelco forms. In an ever changing inductry, training is vitally important. And lastly, you are talking out of your ass.

You get a salary for administrative work. You get a commission for selling.
You have the autonomy to manage your time to meet sales and administrative responsiblities. If you don't like it perhaps you should consider a profession that requires a union card.

This is just the thing though. We have "autonomy" to make our our schedules and work less than 40 hours. On the other hand, doing that in a way that most of us would define as flexible is against company policy and you could be fired for it..... So therefore we do NOT have autonomy.

What about the simpletons like you who do not know what they are talking about? Down time in our industry is work time. Down time is not considered "Time Off" since the representative has to be waiting to be engaged in work and is not free to go about and do non-work activities.

The compensation, following years of BI appeals, will be in the high 4 figures per rep. Total cost to BI to be in the 80-100 million dollar area. The fewer of you who enroll, the larger the final payout to those who do.

By the way - personal miles are charged to your W-2 as personal income.

Do you even know how class action lawsuits work or did you just watch Law & Order reruns to come up with this crap? It is going to trial by jury so no one can claim to know how much the settlement will be, if any, or when. Also, if fewer enroll it doesn't mean each person gets more.
Its scary to think how many idiots we have in the sales force who will sign up like they just discovered a shortcut to the front of the welfare line because some scumbag lawyers promise an easy buck by holding up your employer. Nice.

I guess most of you idiots don't understand that your job is being petitioned to be hourly in terms of compensation. When that happens, there will be no reason for any IC being paid because you want to be paid hourly. This would allow you to gain overtime, but hopefully the company would put into place some way of detecting how many hours you do put into the job. Maybe GPS, or timed computer signatures, or some other method. I am not sure the industry would not consider reducing the income to only salary and allowing overtime when worked along with your 20 minute breaks in the afternoon, and 45 minutes or so for lunch. What a government mentality! What is amusing is to read that some of you think you will actually receive significant money. We'll see. If this lawsuit is successful, you can count on massive changes to your work life, or no work life at all.

Don't you get it? The intent is to aggravate Marty, Paul and Bob – make life miserable for them – at any cost. The people running this company are not liked. If Werner, Shelly and Jim were still in control, it would be unlikely that anyone (in sales) actively employed by the company would sign on. These guys should have kept Hector around. He could have taken some of the flack.

And that is why any type of real sales laughs at pharma.
I use to work at BI, now I am OR sales. I just received this letter and laughed at it and tossed it in the trash. If people would work half as hard at their job as they do at trying to get free money, they would be very wealthy.
What do you think you are going to get? $1000 tops? AFter 5-7 years of fighting this? All pharma is watching this - if BI loses the belt will tighten on all pharma.
The best thing about outside sales is you have the rope to climb to the top -without some pencil pushing desk jockey watching over your every move. One thing that is starting to happen now is phone tracking. The pharma company gives the rep the phone and makes them have it on them. They real-time track your movements with this phone. That is the future of outside reps if silly, narrow-sighted lawsuits like this win.
It's crazy what kids these days are lazy enough to do.
