Arthrex v KFX on knotless double row patents

Anybody know how this is going?

 

Arthrex completely lost last hearing.

 

The order issued by the district court is the culmination of the claim construction process which determines the meaning and scope of the asserted patent claims. In KFx’s lawsuit, six terms used in the ’311, ‘942, and ‘969 patents were in dispute. In each instance, the judge ruled in KFx’s favor regarding how those terms will be interpreted at trial. In otherwords, KFX will win easily at trial.

 

So will Arthrex have to stop selling suturebridge and all other knotless double row anchors?

 

Seriously? That's a lot of dollars! Do SN JNJ Conmed, etc have to stop as well?

 

How much will Arthrex have to pay KFx?

Everybody relax. Of course kfx is going to go after the 800lb monster. Why? Because Arthrex has the market share, and deeper pockets. Arthrex will rename the technique and this will be put to bed. Companies only resolution to sucking is to sue Arthrex instead of producing a better product. This shall soon pass.

 

This has been going on since Jan 2011... This will not just pass as you say. KFX is definitely calling this early round a win, and the Judge most definitely saw it that way as well. Arthrex has had 2 years to "rename" this. Not that easy, expect KFX to try and get the most out of this as possible as that is their goal.

Proving damages is easy. How much have we sold in double row since violating the patent? Millions and millions. The award will be 10 x minimum what we have sold. We are going to get spanked hard on this one. People will get let go. Budgets will be slashed. Not good.

 

How many other patents has your company violated? Endobutton, bioraptor, suretak? Dear lord, does it ever stop? Oh sorry your 4mm x 12mm button isn't the same as ours......

 

Is Reinhold himself going to have to testify? I'd pay money for that show!
