    Abbott Laboratories (ABT)’ victory in overturning a $1.67 billion patent-infringement verdict won by Johnson & Johnson (JNJ) will stand, a U.S. appeals court said today.

    The U.S. Court of Appeals for the Federal Circuit in Washington denied a petition to reconsider a Feb. 23 decision that threw out the biggest patent-related damages award in U.S. history, according to a notice on the court website. J&J had claimed Abbott’s Humira arthritis medicine infringed its patent, and the appeals court said the patent was invalid. The news is a complete devastation for JNJ who now operates without a patent on their number one drug, Infliximab or marketed name Remicade. Biologic AB rated clones or "generics" could be available as soon as December 2011 for the number two drug in the arthritis biologic class. This bad news comes off a 2010 which saw record suits and expensive settlements for the drug giant.

    The case is Centocor Inc. v. Abbott Laboratories, 10-1144, U.S. Court of Appeals for the Federal Circuit (Washington). The lower court case is Centocor Inc. v. Abbott Laboratories, 07cv139, U.S. District Court, Eastern District of Texas (Marshall).
