    Billing for medically unnecessary services – this includes furnishing services in excess of the patient’s needs, based on their diagnosis; or furnishing a battery of diagnostic tests, where, based on the diagnosis, only a few were needed; it also includes misrepresenting the diagnosis to justify the services or products.

    These are civil issues. Can be addressed with a good compliance program(Ahem)! As long as there are no criminal or administrative aspects.

    For the payout Miraca Holdings agreed to, “while admiting no wrongdoing”, it certainly appears “some wrong” was done. Otherwise, why agree to $63.5M?

    The best part is those that did the wrong are likely still with the company having placed the knife in the back of those that left to get away of such shady practices.

    $63.5M is not what they got in the end. Question is whether worth of company is $10M free and clear of all liabilities or not. Both scenarios look pretty dismal.

    This whole deal with Avista is shady. Something is missing in the story. Initial $220 million intent to buy was not a market price for MLS, it was a firesale price. If the future growth of MLS required significant investments and expertise(stated reason for change in ownership), they would have sold it to a bigger established buyer not Avista. Then something happened during negotiations and they ended up unloading the whole thing for some ridiculous $12-13 million number. In the mean time name Miraca was taken out of BMGL despite of holding 60% stake. First thing post acquisition is change of name and hiring of an ethics officer. Everyone else in the senior management still there. When it smells of a dead fish, it usually is a dead fish.

    So was the settlement due to billing for unnecessary stains or sending cases to different states to be read at more favorable reimbursement rates? Seems like everyone is pretty quiet or in the dark for such a big settlement.

    Does it really matter the reason for the settlement? Zaves, Lash, Priestly, Jacobs are still here. If Avista really wants to turn this around they need to clean house sooner vs. later. They had no ethics and morals before Avista can't imagine they have them now...We are screwed if we want a future with this company. Best we can hope for is the flip is quick..

    The company press release says it is a false claims investigation. That means a whistle blower lawsuit most of the times.

    Add Aaron Hersh to that list. Derm and Urology laugh at what a DB he is. What a useless puke. Get rid of Chiz and BM
    As well. They are a joke. They tried to be tough on our conf call saying derm is/was disrespectful, we shut that down asap and they were silent. No we are not we just know the 2 of you are unproven kiss asses with zero AP sales. Either way every SD and TAS/AM is open to new jobs.

    so accurate. GR told all the SD’s “ we all know AH couldnt sell but if i hear anybody say that publicly they willhave to deal with me, we need to try and give him a chance”. Then he had a couple drinks and said “ AH doesnt have it in him to be a sales leader”.

    He is on borrowed time once the new vp of sales gets hired. So are the DERM rvp’s.
