    It will be amazing to watch the Intarcia Losership claim they didnt know

    Ex-Theranos CEO Elizabeth Holmes says 'I don't know' 600+ times in never-before-broadcast deposition tapes
    Elizabeth Holmes has pleaded not guilty to wire fraud charges.

    Raising money from Intarcia Investors based on claims of being approved even though the FDA problems were well known. Can you hear KG saying "I didnt know" "It wasnt my fault"

    The dog ate my homework or ignorance is bliss defense won't work especially with documented touting of the 1-year ITCA which NEVER existed let alone 6-month.

    Instead, the huge new round consisting of $160 million in equity capital and $50 million in debt gives Intarcia cash to fund Phase III trials on ITCA-650, while maintaining full rights to a compound for which Graves says the regulatory risk is “as close to zero” as any project he’s encountered. Five institutional investors, including hedge fund operator The Baupost Group, debt specialist Farallon Capital management, multinational fund manager Fidelity Investments, and two other unnamed East Coast-based funds, joined existing backers New Enterprise Associates, New Leaf Venture Partners, and Venrock in the round.

    WTF is Chief Design Officer?

    Never heard of such joke title in any company let alone in biotech or pharma. Did he design the drug inside implant with bubbles? What does that baldy bullshitter schmuck know anything quasi-scientific? How did he become the voice of Intarcia as a spokesperson?

    He designed all the keys hanging in the lobby - they unlock handcuffs. When the perp walk happens for wire fraud the execs can grab a key, unlock their handcuffs and try to escape. Time2disrupt

    Whistleblowers are protected under SOX for providing information, causing information to be provided, or otherwise assisting in an investigation regarding any conduct that they reasonably believe violates:
    • federal criminal prohibitions against securities fraud, bank fraud mail fraud, or wire fraud;
    • any rule or regulation of the Securities and Exchange Commission (“SEC”); or
    • any provision of federal law relating to fraud against shareholders
    Mail and wire fraud charges are every federal white collar prosecutor’s favorite tool and appear in nearly every white collar prosecution. The common elements of mail and wire fraud seem simple: “(1) a scheme to defraud, (2) money or property as the object of the scheme, and (3) use of the mails or wires to further the scheme.” (United States v. Binday, 804 F.3d 558, 569 (2d Cir. 2015).) The bedrock of these elements is the “scheme to defraud,” which is typically proven by showing that the defendant made a misrepresentation or omission of material fact. (Neder v. United States, 527 U.S. 1, 25 (1999).)

    SOX also prohibits retaliation for filing, causing to be filed, or otherwise assisting in a proceeding filed or about to be filed relating to:
    • federal criminal prohibitions against securities fraud, bank fraud mail fraud, or wire fraud;
    • any rule or regulation of the Securities and Exchange Commission (“SEC”); or
    • any provision of federal law relating to fraud against shareholders.

    Notice to posters: Before posting give some thought to sentence structure, and the essence of the point you wish to make. And although spelling may not be critical, and internet slang and acronyms are quite fine, you are strongly encouraged to have a modicum of understanding of the meaning of the words you choose. Thank you, the Management.

    Pitchbook said that? Maybe 2 years ago or long before the awful 483, CRL and FDA demand to halt all trials? Yeah the investors are coming after the ULT with the pitchforks alright.
