Anyone know if non compete agreement would be enforced by Shire and would it stand up in court, given the pending buy out ?
It was just meant to scare us. It holds no weight. I could name 20+ people (including executives and scientists) that have left for competitors.
Make sure its a "non-compete" and not just a "secrecy agreement". Where you will not reveal any corporate info. Either way as other poster said, its non enforceable. Especially if they lay you off.
all non completes are uninforcable if you are laid off-if you are terminated for poor performance thats a different issue-resigning thats another issue too it depends on how the state you live in enforces non competes
