Hi everyone, I am looking at switching jobs in pharma and I am not sure if I have a non compete clause or not in Canada. I don't have it as part of my initial contract and don't remember signing one. Any tips, I am thinking of calling HR and asking them for a copy of all documents I signed. I have heard non competes are pretty difficult to enforce and most companies wont try. Just wanting to explore all options available to me to ensure all the ducks are in a row. If anyone has any tips from past experience feel free to share.
Non-compete clauses are virtually I enforceable in Canada. This is from an employment lawyer that I dealt with when I was released from a company several years ago. They tried to make a noncompete clause part of my separation agreement and the lawyer told them to pound sand. The Canadian market is too small to actually enforce these types of clauses. Generally they would put too much hardship on the potential employee.
