Boy do you bozos have it wrong. First off, "enticement" is what sales people should do. The word you are looking for is "inducement" as being possibly a violation. Second, if you offer the same price to all doctors within a limited time frame before a price increase that has been timed annually forever, that is not an inducement at all. Many companies, especially chair-side products like Levulen do the same. Many pharma companies offer bulk sales of commodity products in the same way. Buy two, get one free. You are barking up the wrong tree.

 

You can bet Biofrontera will sell the same way, because it works. What was a clear inducement is what many of the reps used to do without company consent. Give away free product to select doctors to induce them into buying Levulen all throughout the year. When that stopped the reps cried to this day. Go back to work and face reality.

It is called selling the spread and it is illegal. Just because it has been done for years and others do it doesnt make it legal. You can tell the customer that a price increase is coming but you cant explain how that will affect them from a financial standpoint.

That is only legal if the customer figured that out on their own but that is not what RG and his minion managers teach. Verbally they teach this technique and it has been RG's strategy for years. He is the mastermind behind it and the OIG has been alerted to this fact.

 

Does that direction come from RG or does it come from above ?

 

RG directs it. Compliance is clueless or turns a blind eye. Above pressures RG to improve numbers and he gets it done.
