First, let's us examine Why JM got here:

The Board put him in because while Boston Heart was continuing to cruise because of their policy to NOT balance bill out of network and the fact their customers were not getting hate mail from insurance companies because they were under the radar still. AT was bigger and on the radar and was the double edged sword: still balance billing a little AND on the radar. Tough spot. but there could have been a plan to scale back, stop stupid investments, tighten the belts, and really, just keep simple billing that was always in place. But instead, the board put Jim in who threw the levers full throttle and burned cash like a reckless teenage driver

He spent money to change the following and they all failed:

    Expensive recruiters
    Logo
    Tag line
    Advertising
    IOPs
    Comp plan
    Pricing
    Sweet spot
    Award trip
    United
    Product vap light
    Data presented
Paid a consultant to tell them to not pay rent!!!!

    Swings and misses.

This is why you don't put sales people as CEOs. They just don't understand the bottom line.

What else am I missing? What other company burned money wasted? Think, there is a single mother of 2 kids in customer service now out of a job because her salary was spent on a recruiter for a sales rep that didn't last 6 months. And another who salary was spent up on JM plane tickets back and forth from Texas. And 10 jobs lost on the agency that changed the logo. Etc.

here is another swing -- stopped research. no focus here to push this which we know is what is needed most long term guys and gals

and did you say the combo vice prez of marketing/lawyer knew about a chess move to stop paying rent? as specific move to get out of the lease? thats swingging and a missing by JM but also one would have thought that law degree would kick in and tell them NYC mad men that not a good move. If they are a bunch of "yes sir may i have another" people then that is why they stay silent. OR worse they thought it was a good move also?

How about renting a new 2nd building just so the C-level guys could have glass offices in riverchase instead of crappy lakeshore. Best case was both places half full, then lay offs came and both places were ghost towns. How much money could have been saved just by not leasing that 2nd building? I heard 70k a month.

Was Jim just hired to run atherotech into the ground?

Inquiring minds want to know; Have they closed the doors? The time for debating what could and should have been done is over. If, they have closed and locked the doors...SO, Have they?

Jim was not hired as the CEO, he was placed there by the Brman board, which he was/is a member off. The big question is, what were their short-term long-term goals for putting Jim in charge? Was his placement as CEO a placement to attempt to positively affect the success of Atherotech or, was it too slowly systematically dismantle the company knowing bankruptcy was inevitable. As Jim always states, this stuff takes time, well, was it time to bankrupt the company and bleed it of its assets or, the opposite, a final last attempt to turn things around. In 2014, when Atherotech didn't meet it's EBITDA number, business was also at the same time slowing down. Yes the past Management was spending money like crazy, but reimbursements were already slowing end of 2014. So, wonder what the truth is, wouldn't we all like to know?

Jim and the board were either really really really smart and knew what they were doing since day one and knew that bankruptcy would benefit Berhman financially somehow someway or, really really really stupid and miss judged the government, the market and its competitors.

    What do you think?

You negative, non-empathetic, low life, inconsiderate, jerk that has nothing better to do than sit around and watch others struggle in pain. It's sad that you entertain yourself by sitting on your butt waiting to see what's going on around here. Obviously some of you guys are the contributors to our demise, you sat around doing nothing and not selling! Go get a job and leave us alone! Why would anyone get satisfaction to see others lose their job! I pray for all of the folks at corporate and those in the field. Keep your faith! God is good!!
