Would BoD agree to a deal if acquirer refuses to fight Silverberg lawsuit? Conflict?

    It would appear that the Silverberg lawsuit would be a selling point for a suitor if the proceeds of a win or settlement go to the acquirer. As it stands now, the proceeds go back to Dendreon. The acquirer would have no allegiance or loyalty to the BoD named in the suit. If Dendreon would only agree to a deal if acquirer defends against the lawsuit it almost seems like a conflict.

    Anyone who knows about a situation like this please enlighten us? Would the proceeds of the suit go to the acquiring company?

    Acquiring company might want all legal stuff over and done before an acquisition. Who could blame them? Until all that goes away, MG's dirty fingerprints are all over this company.
