Judge vacates $5M arbitration award

    It would break Joe-kers heart to know his own people are not celebrating.

    Masimo committed to fighting the $5m judgement in press release months ago regardless, so this is hardly a surprise. Once again, Masimo couldn't win the case on evidence and lost big at trial ($5 million big). So they hired another legal entourage to work their loophole magic thru joker's signature tactic - affirmative defense - and force a retrial. What I gather from Masimo's press release is there has been no victory for Masimo, just their right to be heard again as confirmed by a judge (the same judge who dismissed the federal case against Masimo titled "USA vs Masimo" - now in appeals as well). And so the ugly sphb story will be told. Again. And the evidence will speak for itself. Again.

    Why would anyone triple down on a bad hand against aces showing? It defies comprehension. Stay tuned I guess, should be quite a finale....... Hope I can stay awake.

    FYI, the US attorney reviewed the false claims allegations almost 4 years ago and declined to pursue them. The plaintiffs then brought the case on their own, with their own team of lawyers - and failed. Trying to use the name of the case to create the idea that the government was in any way involved is totally misleading. The US government was not at all involved beyond the fact that a US attorney wouldn't waste time on it and a US judge then tossed the false claims case out of court & vacated the wrongful termination arbitration award.

    Only real Masimo leadership could be so out of touch. Sorry to pick your cherry, but those lawsuits are still in play jackass. Masimo is no closer to winning them now than they were 3 yrs and $15-20 million in legal fees ago. You should read more.
