Frankly, I think Daiichi has a pretty good argument. Regardless, this is going to take a lot of time and $ to resolve, two things that are in short supply at Esperion.
Daiichi has a great case. Everyone knows Esperion has been full of shit for over 3 years. They can't sell enough to stand on their own feet and have relied on other people's money to keep them in business. If they were doing 100 million per quarter than Daiichi would see an end result coming. Right now all they see is a cash burn. The data was very disappointing and Esperion was looking to hit a home run. Right now Esperion can't get out of the dugout. How is it possible for a company to lose over 97% of its value in 2 years? Would you invest your firms money in Esperion? I think not!
