It is ILLEGAL and it's not even really about the technicality of whether you call it a daw fee or a collection & processing charge. It's illegal because the intent is to induce doctors to over utilize testing. I've personally talked to doctors who have tod me they order the panel on every patient and they order the full panel - both based on the $20-$30 payment.
Whatever makes you happy. HDL must be the ONLY lab doing this. Oh wait, they're not, so EVERY other lab that does this is illegal as well. Bunch of illegal activity I guess.
It is illegal to induce physicians to over prescribe or over utilize. Period!
As a sales rep, you can justify it however you want in your own mind because you are focused on hitting quota and making $$$. I get that.
The average medical assistant makes less than $15/hour. With full benefits offered through most MD offices, total cost of that employee is no more than $20/hour. So, does it take a full employee hour to collect, process and ship the specimens?
Ask yourself this - at any point during your sales presentation, do you present ordering your tests as a revenue generating opportunity for the practice?
Or, would the physician still order the tests, in the same volume, if they did not get paid the $20-$30 each?
Reality is that nothing will likely come of it. As a rep, you'd better hope a disgruntled employee doesn't bring a qui tam and name you. Just because you're being told to do it by superiors doesn't release you from the responsibility of personally following the law and STARK regulations.

Have you wondered why the inflated collection fees with Berkeley stopped as soon as Quest bought them? It's because Quest knows, that as the big boy on the block, it would get extra attention and it wouldn't pass legal muster if challenged.
The best MDL can hope for is that they remain small enough to stay off the radar of Medicare and the OIG.
Yet putting a "phlebotomist" in practices whereby they essentially work as a MA is perfectly legal. You guys are amazing with your "holier than thou" attitudes. Let's completely level the playing field and see who kicks whose rear end. Your business practices are antiquated. Must be getting beat by the little guy. Maybe the little guy works a little harder and is a little Bette than you. Can't handle it huh???
