Anyone know if Esperion will go after people who leave with the non-compete? I had a lawyer review and said it is VERY broad, and for 12 months, but it depends on if Esperion decides to go after people, or decides to let people leave on their own and pursue a better opportunity. I have one of those opportunities, but can't go anywhere, or find an opportunity that doesn't compete with CVD or "Metabolism" Since almost EVERYTHING impacts metabolism! I just want out. But can't go anywhere else apparently until Esperion cuts us, or gives us a broad release from non-compete. I know it doesn't apply in California, but it does apply almost everywhere else. Thoughts?

I would think that Esperion has the brain power to follow through on this. They'll have a hard time paying legal bills. They just don't have money coming in. I would keep quiet on where you go and let them play Sherlock Holmes. This was the craziest non-compete I've seen in years. Esperion is already treading water and they've more important things to do than take a rep to court in Bismark North Dakota because they feel it will destroy a region's numbers. Do what's best for you . NOT ESPERION.

It didn't enter your mind why, you had to sign a non-compete during the Scientific Hiring Process ?

Coupled with the deceitful Scientific Hiring Pricess, wasn't this " Flashing Red Lights" of what the culture would be?

ESPERION is run by lawyers. This is a leverage they use for intimidation.

I would ignore it...but unfortunately many companies ask if you are under a non-compete...and if you are you will not get interviewed...much collusion in the industry...sad culture..pathetic way to deal with people and their Families.

Non competes are worthless in this case. Move on with a smile and understand they will not spend the resources, both time and money, to stop you. If you make it public or tell people on your team, I could see this salty ass company maybe sending you a letter from their “legal department” to try and spoke you. But nothing more. But be smart and no social media and suck it up, be rude, and tell no one where you are going. Reps competing directly still won’t sink this drug...it’s already sunk

Well spoken. Compete against what!! Lol! Like Esperion will be sunk by losing your 18 scripts YTD along with thos refills. This company is toast already.
 


I honestly don't think you've anything to worry about. I've a couple of friends who've left and there was no threats to speak of. My manager knows that the lifespan on the clock is ticking daily on BA so he's a realist. Again, I wouldn't sweat it. Just be quiet on your way out , no social media announcement or updating Linken etc. Just say your moving on . You don't have to say where your going.
 


If Esperion wants to enforce the non- compete they can . This happened to somebody I worked for but different company. They went over to sell a competitor, the agreement was that they could not call on certain accounts for 6 months.

Three possible companies Novartis, Amgen , Regeneron.
I know Novartis will ask during the interview if you have a non-compete .
The others I don’t think so .

Stock is down again today. Nothing to worry about on your end. It's true Novartis will ask about non-compete. With Amgen and Regeneron you've nothing to worry about as they don't look at BA as any form of competition. Its classified as generic statin with those two companies and BA'S market potential is equivalent and impactful about as much as an Esperion rep driving his car through the heart of his territory with the windows rolled down and screaming the brand name at the top of his lungs out the window.

Just stay calm as the company is in desperation mode currently especially if you've performed better than you peers. We all understand that nobody is blowing this drug out of the offices but at least you've got something lined up. As long as you don't go to work for Novartis you'll be fine. Novartis always asks if your involved with a non-compete so they don't have to be tied up in litagation.

We were sold a lie in interviews all the way to the top. I cannot keep high fiving a double digit week of 10, with 8 refills, as success! NON COMPETES ARE WORTHLESS...couldn’t fire off one name on the management team that would pursue you. I have had multiple conversations that if a new spot was found at another Pharma company they would take it. Tell me that would not rock the boat. Only the west/East coast upper management would feel that. And they are pressuring us while sitting at home for 6 months while majority of Pharma see you can’t go productively back selling yet. Some people mouth off so loud on calls the nation notices. What’s your hand now....Hopefully, us good ones, find a replacement ASAP and only carry this as a black eye on a resume

The numbers are beyond pathetic. Just look at some of the other districts numbers. That really shows how weak the numbers are. Lots of bragging during Scientific Interviews on what kinda of numbers they would bring to the table. The whole sales team needs to be replaced or at least 80% of us. Lots of pitiful numbers YTD. My RSM is worthless. The entire RSM team should be shown the door.
