You make some reasonable assumptions and ask equally relevant questions. I would say the alleged insurance fraud ran well beyond 2015. While revenue peaked in the 4th quarter of 2015, I would figure at least half ($120 million) of 2016 revenue will be "fair game" I agree that the Feds will likely confine their recovery of insurance fraud to government programs. I suspect the percentages of government insured scripts is significantly more than 50 %. When you examine the prescribers data, it's pretty clear that much of this drug was funneled through a relatively small group, of very well compensated high prescribers,via a very narrow distribution channel. My guess, about 60-65 % It was an easy, no hassle market.
How they calculate the fines (likely some multiple of the total amount of illegal profits including insurance fraud and any irregularities in the patient testing labs and drug distribution channels) is really unknowable. I would simply say this. We are in the middle of a true opioid addiction crisis. More lives will be lost to opioid overdoses than gun violence or motor vehicle accidents in 2017 if current rates prevail.
Given this environment, what incentive does the government have to spare Insys. It's a small, company, alleged to have unleashed unspeakable harm, with a dangerous "me too" product (fentanyl) now about to launch a second drug (marijuana). I think we could get along just fine without them.
