Just look at all the "arrangements" PLUS has set up with their Uro accounts. How do you think they grew so fast? Organically? Please.....make the Uro's "partners", allow them to bill through their Pathologist on board as a "consultant", and share in the revenue for every test submitted to PLUS.

The urology group pays the pathologist. There is currently also a margin here. Urologist bills for professional work done by pathologist and pays pathologist about 40% of the bill. The remainder covers overhead, such as space for the pathologist and whatever is leftover is profit for the urologist. This legal profit is in addition to any illegal profits via kickbacks as detailed above. This is basically Plus's business plan, you wont hear a plus rep talk about quality of the professional work anymore, only of how much money the urologist will make for every biopsy they perform.

Plus is actually very careful not to make a partnership directly with uro's...rather plus partners with a third entity (mobile lithotripsy as detailed above, for a while it was KnowError) which is capable of funnelling money or techs into the urologist office.

Plus is very creative in ways to violate Stark...another example I know of. Before medicare squashed Knowerror, Plus convinced a group of urologist to refer every positive core for identity testing to Knowerror. In exchange for the steady referrals, Knowerror provided this group with a full time tech to help with taking the swabs, packaging the test, etc...The tech spent 10 hours a week working with KE's test kit and the other 30 hours doing routine tasks to support the urology practice. It is extremely hard to catch a urologist engaging in this type of a Stark violation and Plus knows this, arrangements like this are common with this company.
 


Not to mention illegal consulting agreements for no work other than referrals.

Placing of lab assistants is now illegal in many states including NJ and NY

How does Plus compensate the referring urologists in the case of the lithotripsy venture?
Don't the lemming urologists understand or care that they are violating the Stark and anti-kickback regs by receiving compensation proportional to their referrals?
What is Plus' pitch to the urologists that their scheme is legal?

Sounds like the OIG would have a filed day here and a whistleblower would be well compensated !

First of all D Berg is ex-CEO and dishonest. Left the company after a deal in New England including 2 illegal contracts one involving paying urologists for business via an intermediate company blew up costing the company over 100,000 in legal fees and hush money. Probably fired but I suppose it is possible he left on his own.

Local urologists in a region work co-operatively with a third party in a business venture, such as mobile lithotripsy business. Pathology Laboratory employs a consultant who also works for or owns the mobile lithotripsy business. Pathology laboratory payment to consultant at mobile lithotripsy is proportional to specimens received from urology groups. Consultant passes along the kickback (e.g consultant fee) to the urologist by increasing the dividend paid in their lithotripsy venture if they send pathology to lab paying his consultant fee. This completes the loop.

Switch out lithotripsy for imaging and sounds like it could be something a lab in Texas is doing.
 


Sounds like what everyone is doing!! It's all done after this year .. First imaging , than radiation than pathology: make the money while you can cause its all over soon
